Geographic Scope: This website and our services are intended solely for residents of the United States and Canada. By using this website, you represent and warrant that you are located in the United States or Canada. If you are located outside of these jurisdictions, you are not authorized to use this website or our services.

This website, located at myPSD.org and any mobile application or platform connected or associated with this website, and any information stored therein as well as any products and services offered through any of the foregoing (collectively, “Website”), are owned and operated by TheraPetic® Solutions, Inc. (the “Organization,” “we,” “us,” or “our”). The Website provides information, education, and other services and products to a user of the Website (“you” or “User”).

Acceptance of Terms

This Terms and Conditions document (“Terms and Conditions” or “Agreement”) is a legal agreement between you and the Organization. It states the terms and conditions under which you may access and use the Website and all written and other information and materials displayed, linked to, or otherwise made available through the Website, including, without limitation, text, pictures, graphics, logos, illustrations, audio clips, video clips, computer software and code, as well as information electronically submitted to us via the Website (collectively, the “Website Content”).

Your access to and continued use of the Website constitutes your agreement to be bound by these Terms and Conditions. If you do not accept these terms and conditions, or if you are under the age of thirteen (13), you must not access or use the Website.

Electronic Communications

When you visit this Website and/or send phone messages, text messages, and/or emails to us, you are communicating with us electronically. As such, you consent to receive communications from us electronically. The Organization will communicate with you by telephone, text, email or by posting notices on this Website.

You agree that all agreements, notices, disclosures and other communications that we provide to you electronically (including by posting on our Website) satisfy any legal requirement that such communications be in writing. You further agree that any notices provided by us electronically are deemed to be given and received on the date we transmit any such electronic communication.

Modifications to Terms

The Organization may revise or update the Terms and Conditions at any time without advance notice by posting here and by sending you an email notification to the last email address you provided to us (if any). Use of the Website after such changes are posted will signify your acceptance of these revised terms. You should visit this page periodically to review this Terms and Conditions.

Eligibility & Privacy

Eligibility Requirements

You represent and warrant that you are at least eighteen (18) years of age and that you possess the legal right and ability to enter into agreements including this Terms and Conditions. You are solely responsible for knowing and understanding your local laws concerning standards of content legality. The Organization may, in its sole discretion, refuse to accept your registration due to noncompliance with any eligibility requirement.

Privacy

The Organization understands the importance of maintaining the privacy of your Personal Information. Please review the Organization’s Privacy Policy carefully. This describes how the Personal Information about you may be used and disclosed.

Returns & Refund Policy

General Policy

TheraPetic® does not provide refunds. All proceeds and sales are final since TheraPetic® provides a service that has already been rendered. TheraPetic® cannot guarantee that every airline company, landlord, housing/hotel management, and/or affiliated agents will follow the requirements outlined by the Federal and Canadian rules and regulations which govern Service Dogs (also called Psychiatric Service Dogs – PSD) and Emotional Support Animals (ESA).

Denial of Accommodation

In the unlikely event you are denied an accommodation by an airline company, landlord, housing/hotel management, and/or affiliated agents due to a claim that your service/support animal documentation and/or airline form is not valid, we will provide you with the informational resources to assist you with rectifying any confusion. You are protected against discrimination by Federal and Canadian law.

TheraPetic® cannot be held responsible if an airline company, landlord, housing/hotel management, and/or affiliated agents misinterprets the regulations, improperly enforces policies, or changes policies that are not in accordance with Federal and Canadian regulations and laws.

Important: It is not our policy to provide any refunds for documentation rendered or submitted to entities’ refusal to follow federally mandated guidelines to accept your service/support documentation and/or airline form for your Service Dog, PSD and/or ESA.

Physical Product Returns

TheraPetic® fully guarantees its products and services only for shipped packages like a harness or vest, which does not include the purchase of the Ultimate Package. If you purchased an item that is not satisfactory to your expectations, you may return the item to the return shipping address found on the package for a full refund within thirty (30) days of purchase as evidenced by a postmark.

We do not provide refunds on items that exceed thirty (30) days from the date of purchase. We do not provide refunds on electronically delivered products and services or the Ultimate Package. A restocking and shipment fee charge of 30% is applied for returned items, so you will receive the difference of 70% unless the item is no longer operational, functional, or useable.

If you misrepresent or fraudulently provide any inauthentic information to use our product and services, then you will not be entitled to any refund and your account will be permanently closed.

Shipping & Delivery

At this time, TheraPetic® ships merchandise to locations within the United States, Canada, and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. The risk of loss and title for all merchandise ordered through myPSD.org or its affiliates passes to you, the consumer, when the merchandise is delivered to the shipping carrier.

Code of Conduct

Prohibited Activities

You agree not to use the Website Content or any service the Organization provides in an unlawful way or for an unlawful or illegitimate purpose or in any manner that contravenes our policies, guidelines, rules or the terms and conditions of this Agreement. This includes but is not limited to the following:

You will not:

• Post or transmit a message or information under a false identity for the purpose of misleading others
• Engage in unauthorized use of a credit card
• Post or transmit information that is unlawful, libelous, defamatory, obscene, fraudulent, harassing, threatening or abusive
• Post or transmit information that infringes intellectual property rights or privacy rights of others
• Attempt to disrupt the operation of our business through viruses, Trojan horses, denial of service attacks, or similar methods
• Upload or transmit any unsolicited advertising, junk mail, spam, or any other form of solicitation
• Attempt to gain unauthorized access to any user accounts, computer systems or networks
• Use any robot, scraper or other automated means to access any aspect of our website
• Harvest or collect information about others without consent
• Modify, reverse engineer, decompile, or disassemble the Website

User Accounts

You are not obligated to register with us in order to access and use the Website. However, certain services of the Website are available only to users who have registered with us. You represent and warrant that all required registration information you submit is truthful and accurate, and that you will maintain the accuracy of such information.

You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to immediately notify Organization of any unauthorized use, or suspected unauthorized use of your account or any other breach of security.

Payment Disputes and Chargebacks

If a client initiates a payment dispute, chargeback, or reversal through a bank, credit card company, PayPal, or other third-party payment processor, the associated account will be automatically paused while the dispute is pending. This safeguard protects both the client and our Organization and ensures that no documents, records, or services are altered during the dispute review process.

While an account is paused due to a third-party dispute, access to documents, services, and account features may be restricted and no edits, updates, or reissuances can be made. If a dispute or chargeback is initiated after services have been rendered, the Organization reserves the right to terminate the account and discontinue further services. Reinstatement of account access or services after a payment dispute is not guaranteed.

Good-Faith Participation and Professional Relationship

The services provided through this Website rely on good-faith participation, cooperation, and respectful communication between clients, providers, and staff. The evaluation process requires a professional and therapeutic relationship built on trust, transparency, and mutual respect.

All evaluations, consultations, and documentation are provided according to established professional standards. Services rendered by licensed professionals are performed with the utmost care, diligence, and adherence to applicable professional and ethical guidelines.

Clients agree not to engage in conduct that undermines this professional relationship. This includes, but is not limited to, abusive communications, fraudulent payment disputes, or the public dissemination of knowingly false statements or materially misleading claims about the services, providers, or Organization. Examples may include publishing statements that falsely claim services were not performed, misrepresent the credentials or licensure of providers, or otherwise make demonstrably inaccurate allegations presented as fact. If such conduct occurs, the Organization reserves the right to suspend or terminate services or account access.

The Website Content is educational and informational in nature and is provided only as general information and is not medical or psychological advice, opinion, diagnosis, treatment or guarantee. The Website is not intended to create and does not constitute any professional relationship between Organization and you, and does not create any doctor-patient or any other professional relationship.

Organization Is Not a Medical, Psychological, or Mental Healthcare Provider and Does Not Provide Medical, Psychological or Mental Healthcare Advice. Any and all content stated or posted on the Website or available through any service or product is not intended to be, and must not be taken to be, the practice of medicine or psychology or the provision of medical or psychological care or any other professional healthcare.

The information provided on this Website is not a substitute for medical diagnosis, advice, or treatment, or other professional healthcare. If you have or suspect you may have a medical or psychological or mental healthcare problem, you should consult your medical doctor or psychologist or appropriate healthcare provider. No Legal Claims or Warranties

Important Legal Notice: The Organization makes no claims, guarantees, or warranties with respect to rights or obligations any individual may have with respect to federal or state/province disability or other laws. We do not provide any representation or certification that any given individual has a disability or is entitled to accommodation under relevant laws.

We cannot guarantee that private individuals or governmental entities will agree with any position that any user of this Website may take. Even though a person may have an emotional support animal (ESA) letter from a Practitioner, this in no way guarantees that the person will qualify as “disabled” under federal or state/province law, or receive any particular accommodation by any airline, hotel, restaurant owner, or any other organization or individual.

An ESA is not a “service dog” as defined by law and may not necessarily be accorded the same level of accommodation.

No Credentialing

To the extent the Website lists healthcare practitioners (“Practitioners”), we are merely a directory and do not certify or credential Practitioners and shall not be liable for certifying or credentialing Practitioners. We make no representations or warranties about any Practitioner, nor do we have any responsibility over, or for supervising, any outside clinical practice such Practitioner may operate.

We do not screen, perform background checks, confirm the qualifications, evaluate, or endorse any Practitioner. The inclusion of a list of Practitioners on the Website does not imply recommendation, referral or endorsement of such Practitioner.

No Guarantee or Warranty

The Website is provided on an “AS IS” and “AS AVAILABLE” basis. We do not provide any express warranties or representations. To the fullest extent permissible under applicable law, we disclaim any and all implied warranties and representations of any kind, whether express or implied, or statutory, including, without limitation, any warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.

The domain name for this Website, all page headers, graphics, and button icons are service marks, trademarks, logos, and/or trade dress of the Organization. You agree that you will not use any such trademarks, service marks, trade dress, or other logos from this Website without prior written authorization.

Dispute Resolution & Arbitration

Governing Law

For users in the United States, these Terms and Conditions are governed by and construed in accordance with the laws of the District of Columbia, USA and controlling United States Federal Law without regard to any conflicts of law provisions. For users in Canada, this Agreement shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Mandatory Arbitration

Important – Please Read Carefully: This agreement contains an arbitration provision to resolve disputes. No class or representative court action or jury trial is permitted. Arbitration means there shall not be a jury and that the rules of the proceeding will be conducted in accordance with established arbitration rules of the AAA.

Subject to the provisions of this Terms and Conditions, all disputes, controversies or claims arising out of or relating to this Agreement will be resolved through mandatory binding arbitration that will be conducted in Washington, District of Columbia. Any dispute must be initiated with an arbitrator within one year of occurrence or to the maximum extent permitted by law.

Any dispute that arises may only be resolved through an individual arbitration, and shall not be brought as a class action, a class arbitration, or any other proceeding where a person serves as the representative of any other person or persons. Both parties must keep the dispute confidential, to the maximum extent permitted by law.

Severability

We both agree that if we cannot enforce a part of these Terms and Conditions as written due to a conflict with state/province or federal law, then that part will be replaced with terms that most closely match the intent of the part we cannot enforce to the extent permitted by law. The invalidity of part of these Terms and Conditions will not affect the validity and enforceability of the remaining provisions.

Entire Agreement

This Terms and Conditions constitutes the sole Agreement between you and the Organization relating to your use of the Website Content, and no representations, statements or inducements, oral or written, not contained in this Agreement shall bind either you or the Organization.
